Some attorneys pride themselves on taking aggressive positions and pushing every case to trial. Not us. At the Law & Mediation Offices of Julia M. Tracy, we know that family law trials are rarely in the interest of you, our client, and are almost never in the best interest of your children. Trials are financially and emotionally exhausting, draining resources that could be better spent on your family.
We also know that it is impossible for any judge to know as much about you, your financial circumstances, or your children, as you do.
And we know that parties who actively participate in reaching a settlement are much more likely to see their agreement as fair, and to abide by it, than those who have an order imposed upon them by a judge. That means more cooperation between the parties on a day-to-day basis, and less running back to court to modify or enforce orders.
Therefore, we work diligently to gather all the necessary facts, to advise you of the law, and to make every effort to negotiate a settlement that everyone can live with.
If all settlement efforts fail, and trial is unavoidable, we provide thorough, assertive, and effective representation.
Mediation, whether court-ordered or voluntary, offers parties an opportunity to resolve their disputes themselves, with the assistance of a skilled mediator (who represents neither party). This enables them to avoid the time and costs of litigation; ensures that each party has a chance to voice their concerns to the mediator and have those concerns addressed; and puts the decisions regarding their family’s future in their own hands, where it belongs.
Collaborative law offers parties the comfort and confidence of being represented by a knowledgeable attorney who is looking out for their interests, without the financial and emotional costs of litigation. It is a kinder, gentler divorce process in which parties cooperate with each other and their collaborative attorneys to achieve a settlement that works for them and their family. Settlement possibilities are expanded because the parties are not limited in fashioning an agreement in the way that judges are constrained by the law.
Julie Tracy is a true believer in the many benefits of non-litigation approaches to divorce. That belief, along with her experience and training, has made her a highly effective mediator and collaborative attorney.
At the Law & Mediation Offices of Julia M. Tracy, we will prepare powers of attorney to ensure that your wishes with regard to property and health care are effected during your lifetime. We will also work with you to develop a customized estate plan to arrange for property transfers and guardianships (if needed) upon your death, either by will or other means.
If you are called upon to administer an estate after the death of a loved one, we will represent and assist you through every step of the probate process.
Sometimes one side or the other to a legal dispute (or both!) might think that the trial court got it wrong. After all, no one is perfect. Appellate courts review the rulings of the trial court, so that serious errors can be fixed.
At the Law & Mediation Offices of Julia M. Tracy, we are experienced in assessing whether an appeal should be taken, drafting appellate briefs, and arguing before the appellate court. If you are considering an appeal, or are forced to defend an appeal by the other side, contact us promptly. Time is of the essence.
